TO THE HONORABLE THE JUDGE OF THE PROBATE COURT IN AND FOR THE COUNTY OF SUFFOLK:

RESPECTFULLY represents Robert A. Swanton and Leo D. Crowley, both of Boston, Suffolk County Massachusetts:

  1. That they are named as Executors in the Will of William Swanton dated July 13 1928, now on file in this Court and have petitioned for the probate of this Will in this Court.
  2. That on August 9, 1929, one Kate Bradfield, or Seaview, Lislevane, Timoleague, County Cork, Irish Free State, filled her appearance against allowance of said Will, and filed a Motion to Stay proceedings on said Will, and in said Motion states that she is the Executrix named in a Will executed by William Swanton on June 15th, 1929, on which day he died, which Will was executed in the Irish Free State, and further states that the deceased William Swanton, at the time of his death, was a resident of and domiciled in the Irish Free State; and that his alleged late Will executed on June 15th, 1929, has been offered for probate in Clonakilty, County Cork Irish Free State, and that proceedings for the allowance of said Will have been begun in said County of Cork.
  3. That the said deceased, William Swanton, at the time of his death on June 15th, 1929 and for a great number of years prior thereto, was a resident of and domiciled in Boston, in the County of Suffolk, Massachusetts.
  4. That by reason of the fact that he was domiciled in said Boston, at the time of his death, his last Will should be originally offered for probate before this Court, and probate of said Will taken out in this Court and not in the Irish Free State.

WHEREFORE your petitioners pray:

  1. That this Honorable Court establish by its decree that the said William Swanton was domiciled in Boston, in the County of Suffolk, Massachusetts, on June 15th, 1929, the date of his death..
  2. That the said Kate Bradfield be cited by this Court to produce and deliver to this Court any last Will of said William Swanton dated June 15th, 1929, which she alleges in her Petition was executed by said William Swanton, and that she be required to prove said alleged last Will of June 15th, 1929, in this Court.
